Copyright Infringement Reporting Procedure
RandomTranslator is an online service provider as defined by the Digital Millennium Copyright Act (DMCA). We respect copyright laws and take the protection of intellectual property seriously. If you are the rightful owner of any content displayed on RandomTranslator and do not authorize its use, you may notify us by sending an email to [email protected] so that we can review and take the appropriate action.
DMCA Notice Requirements
A notice must contain all of the elements below. These are the requirements set out in Section 512(c)(3) of the DMCA — if any are missing we may not be able to act on your notice, and we may ask you to resubmit it.
- Your physical or electronic signature.
- Identification of the copyrighted work you believe has been infringed. If several works are covered by one notice, a representative list of them.
- Identification of the material you believe is infringing, with enough detail for us to locate it — normally the full URL of each page concerned.
- Your contact information: name, physical address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.
Please send notices only for material you own or are authorized to represent. Knowingly making a material misrepresentation that content is infringing can carry liability for damages under Section 512(f).
Our Commitment
We review every complaint we receive and act on valid notices without unnecessary delay. Upon receiving a valid DMCA notice, we will:
- Acknowledge receipt of your notice.
- Review the material identified in it.
- Remove or disable access to material that appears to be infringing.
- Notify the user who provided the material, where one is identifiable, and pass on a copy of the notice.
- Record the notice against the account concerned for the purposes of the policy below.
Repeat Infringers
We keep a record of valid infringement notices against each account. An account that is the subject of repeated valid notices will have its upload and posting privileges suspended, and may be terminated entirely. We reserve the right to terminate an account immediately, without prior warning, in cases of clear or deliberate infringement.
Counter Notification
If material of yours was removed and you believe it was removed by mistake or misidentification, you may send a counter notification to [email protected]. It must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the district in which you live, or — if you are outside the United States — any district in which we may be found, and that you will accept service of process from the party who sent the original notice.
We will forward your counter notification to the party who sent the original notice. If they do not notify us within 10 business days that they have filed a court action seeking to restrain the activity concerned, we may restore the material, generally between 10 and 14 business days after we receive your counter notification.
