The 9th Division was the division where Tosen Kaname's friend, Tsunayashiro Kakyō, had served.
As a member of the Prison Squad, when one of their own died, it was painful to uncover some of the truth yet be unable to bring the killer to justice because of his noble status. In circumstances like these, the 9th Division could only show a little kindness to the living—to Kakyō's friends.
Otherwise, under normal circumstances, when a Soul Reaper died or retired, their Zanpakuto would remain with their division. It was not allowed to end up elsewhere.

Kyoraku Shunsui sighed, then said to Natsuki, "I've already informed Central 46 about what Tsunayashiro Tokinada did. They've begun investigating him. He didn't try to cover up what he did—instead, he made a big show of it. Plenty of people know about his actions, so Central 46 should be able to gather enough evidence to pass judgment on him before long."
"Will he die?" Natsuki asked Kyoraku Shunsui.

Kyoraku Shunsui had said earlier that, given Tsunayashiro Tokinada's status, the most they could do was strip him of his Soul Reaper title, confiscate his Zanpakuto, and imprison him. There was no chance he would be executed.
